Terms and Conditions

Welcome to AasPass - Global to Local. AasPass Tech Enterprise Firm ("us", "we", or "our") operates the aaspassapp.com website. This policy sets out how AasPass - Global to Local collects and uses the information that we collect about you when you use the AasPass - Global to Local services. This policy also explains the choices that you can make about the way that we use your information.

Services​

  • The Platform allows vendors ("Vendors") i.e. small businesses to list their catalogue of products/services, record their transactions, such as the sale and purchase of goods and services, with their customers (“Customers”), maintain a record of their credit with the Customers and allows Customers to place orders with the Vendors. In addition, the Platform uses technology to facilitate transactions between Vendors and Customers and uses data-backed insights to meet Customers' untapped needs.

  • Vendors and Customers are collectively referred to as “Users”. For the avoidance of doubt, a Vendor may be considered a Customer in certain transactions (and vice versa). For example, in a situation where a Vendor purchases goods and services from a supplier and this is recorded on the Platform, the Vendor would be considered a Customer and the supplier a Vendor.

Account Creation​

  • To avail of the Services, a Vendor would be required to create a Shop(“Profile”) on the Platform. In addition to setting up a username and password to create the Profile, the Vendor will be required to furnish certain details, including but not limited to phone numbers and details of their business. The Vendor warrants that all information furnished in connection with its Profile is and shall remain accurate and true in all respect, and agrees that it shall promptly update its details on the Platform in the event of any change or modification.

  • The Vendor is solely responsible for maintaining the security and confidentiality of its username and password and agrees to immediately notify the Company of any disclosure or unauthorised use of its Profile or any other breach of security with respect to its Profile.

  • The Vendor expressly agrees to be liable and accountable for all activities that take place through its Profile. The Company shall in no manner be held liable for any unauthorised access to a Vendor's Profile.

  • The Vendor agrees to receive communications from the Company regarding (1) information relating to transactions recorded on the Platform; (2) requests for payment; (3) information about the Company and the Services; (4) promotional offers and services from the Company and its third-party partners, and (5) any other matter in relation to the Services.

KYC Policy​

  • The Company may require Users to upload certain information and documents that may be necessary to ascertain their eligibility to use Terms & Conditions - AasPass 1 certain features of the Services including but not limited to their identification documents (“KYC Documents”).

  • The User hereby authorizes the Company and any third-party service provider it may engage with or interact with in connection with using the Platform to process KYC Documents and ascertain the User’s eligibility. Any processing undertaken by the Company shall be in accordance with its Privacy Policy and these Terms. It is hereby clarified that as far as the permission of the KYC Documents by a third-party service provider is concerned, the same shall be governed by the privacy policy of such third-party service provider.

  • The User agrees that it may be required to submit additional documents as and when required by the Company or any of its third-party service providers and if, in such an event, any additional information, data, or documentation is required, the User hereby agrees to share these documents promptly upon request, and further, authorizes the Company to process these documents.

  • The User agrees and warrants to provide valid, true, complete, and up-to-date KYC Documents. The User further acknowledges that any incorrect or misleading information provided shall constitute a material breach of these Terms, and the User’s access to certain features of the Services may be limited or denied in such an event.

  • The list of the KYC Documents may be provided to the User at the time of creating the Profile/signing up or at a later stage.

Consent To Use Data​

  • You agree that the Company and any third-party service providers it engages, may, in accordance with its Privacy Policy, collect and use your information and technical data and related information.

  • The Company may use information and data pertaining to your use of the Services for analytics, trends identification, and purposes of statistics to further enhance the effectiveness and efficiency of the Platform.

  • Subject to applicable laws, the Company may be directed by law enforcement agencies or the government and related bodies to disclose data in relation to Users in connection with criminal proceedings. You understand and agree that in such instances, the Company shall have the right to share such data with relevant agencies or bodies.

Fees/Charges​

  • The Company reserves the right to charge a convenience fee for the Services and non-payment may result in denial of Services

Modification​

  • The Company reserves the right at any time to add, modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without cause. The Company shall not be liable for any such addition, modification, suspension or discontinuation of the Services.

Payment

  • The installation and use of this Website/App are free of cost and this includes only the usage of certain services of the Website/App. However, the User understands that in the event he orders any AasPass App products he shall be required to pay for the same (“Product Price”).

  • Product Price paid by the User is final and non-refundable unless otherwise determined by the Company. User is expressly agreeing that the Company is permitted to bill him for the applicable price, any applicable tax and any other charges he may incur in connection with the products ordered from the Application/Website of the Company.

  • The company reserves its right to initiate appropriate legal proceedings, if necessary, in its sole discretion, to recover any outstanding amounts.

  • ​The Company at its sole discretion reserves the right to establish, remove and/or revise Prices for any or all products displayed to the User through its Platforms. Further, the User acknowledges and agrees that the Product Price applicable in certain geographical areas may vary depending on various existing factors. AasPass InfoTech will use reasonable efforts to inform the User of the Product Price that may apply, provided that the User will be responsible to pay the Product Prices incurred to the Company.

Return Policy 

  • Users may reject the receipt of Products in the event the Products delivered are not in accordance with the order placed by him or are damaged at the time of delivery.

  • Users may cancel the order placed on the Website and/or Application by contacting the Company's customer care at hello@aaspassapp.com, In event of a cancellation of the order, the Company shall refund the payments subject to its refund and cancellation policy.

  • In the event Company suspect any fraudulent transaction by the User or any transaction which defies the terms & conditions of using the Website and/or Application, the Company in its sole discretion, may cancel such orders. All orders which are not dispatched will be considered as purchase order till the time it gets dispatched from our system. AasPass InfoTech holds all the rights to modify/alter/update or cancel the purchase order.

Delivery of Products

  • All Products will be delivered at the address provided by the User in the registered Account or any other alternate address as specified by the user at the time of placing the Order. The delivery may be made by the personnel appointed by the Company or by any third-party service provider engaged by the Company for such purpose. The company shares your personal information with the delivery executive on a ‘need to know basis as may be relevant for completing the delivery of the Product. 

  • Any timeline for delivery specified by the Company is a genuine pre-estimate of the time required by the Company for completing the delivery of the Product. The user acknowledges and agrees that actual delivery may be delayed and takes longer than the delivery timeline. However, the Company will keep the User informed of the order status as may be appropriate from time to time. 

  • The user acknowledges and accepts that all Products delivered shall be verified by him for accuracy and apparent damage at the time of delivery. The user (or his authorized representative) will be required to sign a delivery confirmation on receipt of the Order.

Miscellaneous Provisions​

  • Modification – The Company reserves the right at any time to modify these Terms and to add new or additional terms or conditions on the use of the Services. Such modifications and additional terms and conditions will be communicated to you and, unless expressly rejected (in which these Terms shall terminate), will be effective immediately and will be incorporated into these Terms. In the event you refuse to accept such changes, these Terms will terminate.

  • Severability - If any provision of these Terms is determined by any court or other competent authority to be unlawful or unenforceable, the other provisions of these Terms will continue in effect. If any unlawful or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect (unless that would contradict the clear Terms & Conditions - AasPass 1 intention of the clause, in which case the entirety of the relevant provision will be deemed to be deleted).

  • Assignment - You shall not license, sell, transfer or assign your rights, obligations, or covenants under these Terms in any manner without the Company’s prior written consent. The Company may grant or withhold this consent in its sole discretion and subject to any conditions it deems appropriate. The Company may assign its rights to any of its affiliates, subsidiaries, or parent companies, or to any successor in the interest of any business associated with the Services without any prior notice to you.

  • Notices - All notices, requests, demands, and determinations for the Company under these Terms shall be sent to hello@aaspassapp.com

  • Third-Party Rights - No third party shall have any rights to enforce any terms contained herein.

  • Translations - The Company may provide you with translated versions of these Terms solely to assist you with understanding these Terms in greater detail. The English version of these Terms shall be controlled in all respects. In the event of any inconsistency between the English version of these Terms and any translated version, the terms of the English version shall prevail.
